This website is owned and operated by searchESS Pty Ltd (ESS). All orders and purchases made through the facilities of this website shall be subject to these Online Shopping Terms and Conditions.
ESS may correct errors or inaccuracies and change or update information on this website at any time without notice, including in respect of prices and availability of items. All prices listed on this website are in Australian dollars and all charges will be processed in Australian dollars.
ESS reserves the right to limit the quantities of certain items which can be purchased. ESS will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated; however, ESS will not be responsible for any delays in delivery which are beyond its control.
All orders will not be processed without payment being made in full amount. Payment can be made via credit card at point of order, Electronic Funds Transfer (EFT), Credit Card “Pay an invoice online” via the website https://www.searchess.com.au/pay/.

Security
Credit card payments are secured using 128-bit SSL encryption. This ensures all credit card details you send to us via the internet will be encrypted. If any other user intercepts the communication, they will only be able to view the encrypted form. This makes it impossible to be intercepted by an unauthorized party as long as your browser supports the use of encrypted data transmissions.
Refunds and Cancelations
ESS has the right to reject any order for any reason and will refund any money less any admin fees. Refunds will not be given if requested has already been processed by ESS staff.
Requests can be cancelled for any reason but must be done so in writing via email to ess@topmarksolutions.com.au. Orders are unable to be cancelled and or refunded if the provider has already processed search requested. We will try to process any requests for cancelation but are unable to guarantee the request can be filled.
Delivery
Whilst every effort will be made to deliver searches ordered within two (2) business hours of an order being placed ESS will not be held responsible for delays due to unforeseen issues, provider outages or other events which may delay search processing and delivery.
For any searches ordered outside of normal business hours the 2 business hours commences at 8.30am on the next business day. Business Days are defined as Monday to Friday 8.30am to 5pm excluding public holidays.
